Lackawanna County judge asked state to review guardian system for children
The office manages the court system of Pennsylvania was asked to review the system of guardian ad litem to oversee the interests of juveniles caught in custody disputes in Lackawanna County Court.
President Judge Thomas J. Munley said the request was made recently at the Administrative Office of Pennsylvania courts, which is the administrative body of the highest court of the state.
Judge Munley said he does not know when or even if, considering AOPC would start, but the judge has already made some adjustments.
"There was a change in how we monitor what is going on (with) guardian ad litem," Judge Munley said Wednesday.
Workers involved in the court ordered inspection visits at home after hours can no longer accept checks or cash.
"Ad litem" is a Latin phrase meaning "for the prosecution," in essence, for the duration of legal proceedings given. In divorces or custody disputes, the guard looks out for best interests of the child.The work involves interviewing the child, parents, teachers and just about anyone else who has information on family dynamics and child.
If agreement can not be developed, the tutor writes a report to the judge to recommend what should be done by court order.
In a court order dated May 19, the judge said the payments Munley inspection visit at home, usually about $ 50, must be filed with the clerk of the criminal record, family division, where it will be deposited in the fund General. The county would then have a check to the worker for the visit.
On another note dated June 14, Judge Munley ordered supervisors, who are paid $ 20 an hour, their fees must also file with the clerk of the criminal record. The county will later issue a check to her supervisor.
John O'Brien, the county attorney, described the changes as "just tweaking."
"I do not think it's a big deal," he said.
